1. AGREEMENT TO TERMS

By accessing the website at https://www.kikowebdesigns.com (the “Site”) and using our services (the “Services”), you agree to be bound by these Terms of Service. If you do not agree, you are prohibited from using the Site and Services.

2. SERVICE MODEL & OWNERSHIP

Kiko Web Designs provides services through a subscription model that includes an initial setup fee and ongoing monthly services:

  • Setup Fee: A one-time setup fee is charged at the beginning of your project to cover initial website design, configuration, and setup of marketing platforms.
  • Monthly Subscription: Ongoing marketing and web services are provided for a monthly fee. This is a month-to-month subscription with no minimum commitments.
  • Ownership: Kiko Web Designs retains all rights to the custom code, design, and architecture during the subscription period. Upon completion of the Initial Service Term and final monthly payment, full ownership of the website’s custom code and design is transferred to you.
  • Cancellation Options:
    • Option 1 - Downgrade to Maintenance Only: You may downgrade to a website maintenance-only plan (hosting, security updates, and analytics) and discontinue marketing services. Maintenance fee applies.
    • Option 2 - Cancel All Services: Kiko Web Designs will provide you with a complete backup of all website files and assets at the end of your billing cycle. If you have completed the Initial Service Term, you will have full ownership of the custom code and design. You will be responsible for setting up hosting and maintaining the website independently. No further fees apply.
  • Third-Party Platforms: All third-party platform accounts (Google Business Profile, Google Ads, social media platforms, email marketing platforms, etc.) are registered and maintained in your name. You retain full ownership and control of these accounts regardless of subscription status.
  • Client Portal Services: Client portals provided by Kiko Web Designs (such as reputation management systems) will be deactivated upon cancellation.

You always own your domain name, your logo, and any photos/text you provided to us.

3. “5-STAR TOOLKIT” & EMAIL TRAINING

  • Purpose: Any “Free Toolkits” or “7-Day Courses” offered are for educational purposes only.
  • CASL Consent: By requesting these items, you are making an “Inquiry” under Canada’s Anti-Spam Legislation (CASL). You consent to receive the requested materials and a related sequence of emails. You may unsubscribe at any time via the link in our email footer.

4. MONTHLY UPDATES POLICY

Monthly updates are included with the subscription model and include:

  • Content Changes: Up to 1 hour per month of content changes (text updates, photo swaps, or business hour changes). Unused hours do not roll over to the next month.
  • Bug Fixes: Up to 3 hours per month of bug fixes and development time at no additional charge.

Additional Work: Any work beyond the included hours (content changes or bug fixes) will be performed by Kiko Web Designs at a rate of $150.00 per hour.

Exclusions: Monthly updates do not include:

  • Designing entirely new pages or landing pages.
  • Advanced custom functionality or e-commerce features.
  • Full site re-designs.

New features or pages will be quoted as separate, one-time projects.

5. DIGITAL MARKETING AND WEBSITE SERVICES

Kiko Web Designs provides comprehensive digital marketing and website services, including but not limited to:

Website Services:

  • Website design and development
  • Website hosting, security updates, and maintenance
  • Website performance optimization and analytics
  • Technical support and bug fixes

Digital Marketing Services:

  • Google Business Profile optimization and management
  • Social media strategy and content management
  • Local SEO and directory citation management
  • Review monitoring and management
  • Performance analytics and reporting
  • Monthly strategy consultation and performance reviews

Service Scope and Deliverables: Specific services, deliverables, and service packages are detailed on our website and in your client agreement. Changes to service packages, pricing, or deliverables will be communicated to you in advance and reflected in updated agreements.

Third-Party Platform Management: You are responsible for registering and maintaining your own accounts with third-party platforms required for marketing services (e.g., Google Business Profile, social media platforms, email marketing platforms, etc.). Kiko Web Designs provides strategy and consultation on how to use these platforms effectively, but you retain full ownership and control of your accounts.

6. SEO & RANKING DISCLAIMER

While we use industry-standard optimization techniques, Kiko Web Designs does not guarantee specific rankings on Google Search or Google Maps. Search engine algorithms are controlled by third parties (Google) and are subject to change without notice. We are not liable for fluctuations in traffic or rankings.

7. FEES AND PAYMENT

  • Automatic Billing: Subscription fees are processed every 30 days.
  • Late Payments: If a payment is more than 10 days late, Kiko Web Designs reserves the right to temporarily suspend the website until the account is brought current.

8. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Kiko Web Designs shall not be liable for any indirect, incidental, or consequential damages (including loss of profit or revenue) arising out of your use of our services. Our total liability is limited to the amount paid for one (1) month of service.

9. INDEMNIFICATION

You agree to defend and hold Kiko Web Designs harmless from any claims resulting from your use of the Site or any copyrighted materials (logos, photos, copy) you provide to us for the website.

10. GOVERNING LAW & PRIVACY COMPLIANCE

These Terms shall be governed by and defined following the laws of British Columbia, Canada. You irrevocably consent that the courts of British Columbia shall have exclusive jurisdiction to resolve any dispute.

Local Privacy Compliance (PIPA): In accordance with the British Columbia Personal Information Protection Act (PIPA), Kiko Web Designs is committed to protecting the personal information of our clients and website visitors. We collect, use, and disclose personal information only for purposes that a reasonable person would consider appropriate in the circumstances.
